“Personal data” as defined under Singapore's Personal Data Protection Act (the “PDPA”) means data, whether true or not, about an individual who can be identified from that data, or from that data and other information to which an organization has or is likely to have access.

Neoptics has implemented generally accepted standards of technology and operational security to protect the personal data in our possession or under our control and to prevent any unauthorized access, collection, use, disclosure, copying, modification, leakage, loss, disposal, and similar risks. Only authorized Neoptics personnel are provided access to personal data, and these personnel have agreed to ensure the confidentiality of the personal data. 

While all electronic transmissions carry inherent security risks, we cannot assume responsibility for any unauthorized use of your personal data by third parties which are entirely due to uncontrollable external factors.

We may retain your personal data for the shortest time necessary for which it was collected, or as required or permitted by applicable laws. We will cease to retain your personal data as soon as it is reasonable to assume that such retention no longer serves the purpose for which the personal data was collected and is no longer necessary for legal or relevant business purposes. 

The duration of retention is determined by specific service specifications and legally permissible operational requirements. We process and retain personal data in compliance with applicable laws and regulations. We take appropriate measures to protect information integrity and prevent unauthorized access.

4.How We Share, Transfer, and Disclose Your Personal Data

(1) Share

We may share your personal data with any member of Neoptics and its subsidiaries (collectively the “Neoptics Group”), which may be based in countries other than Singapore, from time to time for one or more of the Purposes. We will not share your personal data with entities, organizations, or individuals outside of the Neoptics Group unless compelled by legal obligations or regulatory compliance requirements.

In the event that there is a need to share your personal data with third parties, we will follow the following principles:

A.Sharing with third-party service providers: We collaborate with third-party service providers for digital infrastructure development, storage, backup, and platform maintenance, where such processing activities require controlled data access or use information about you. Any third party whom we engage will be contractually obligated to maintain the confidentiality of all information.

B.Sharing personal data when permitted: Upon receiving your explicit consent, we may share your personal data with authorized third parties that are essential for service delivery.

C.Sharing personal data when required by law: We may share your personal data with authorized entities when compelled by statutory obligations, legal proceedings, or lawful directives from government agencies and judicial bodies.

(2)Transfer

During data processing operations, your personal data may be transferred to and stored outside your country in which you reside. This includes countries beyond Singapore, as well as those that may not offer the same level of data protection frameworks as your home country.

(4)Exceptions to Prior Authorization and Consent

Under the PDPA, the following processing activities are exempt from prior consent requirements:

A.Essential for safeguarding vital national security interests or fulfilling statutory public interests mandates as prescribed under PDPA;

B.Essential for responding to an emergency that threatens the life, health, or safety of the individual or another individual;

C.Essential for the legitimate interests of Neoptics, and they outweigh any adverse effect on the individual; and

D.To comply with other requirements as provided by relevant laws and regulations.

5.Your Rights

Under the PDPA, you may have the right to (a) request correction or rectification of personal data in our records; (b) withdraw previously provided consent at any time; (c) gain access to your personal data; or (d) seek policy clarifications regarding data processing. To securely process your request in compliance with legal obligations, we will require sufficient information from you to verify your identity. We will endeavor to provide a response within 30 days as required by applicable laws and regulations, and if unable to meet this timeline, we will notify you of the extended response time. We may decline the request if we have reasonable grounds to believe that it could reasonably be expected to (a) threaten the safety or physical or mental health of an individual other than the one who made the request; (b) cause immediate or grave harm to the safety or to the physical or mental health of the individual who made the request; (c) reveal personal data about another individual; (d) reveal the identity of an individual who has provided personal data about another individual and the individual providing the personal data does not consent to the disclosure of his or her identity; or (e) be contrary to the national interest.

Upon receipt of your written request to withdraw your consent, we will cease (and cause any of our data intermediaries and agents to cease) collecting, using, or disclosing the personal data unless such collection, use, or disclosure without the individual’s consent is required or authorized under applicable laws. Withdrawal does not affect the lawfulness of the processing of your personal data based on your consent prior to withdrawal; nor does it affect any data processing based on other lawful bases.
